WHEREAS:

The nations of Denmark, the Netherlands, Norway, Sweden, Ireland, France, Switzerland, Brazil, Australia and Canada recognize the right of same sex couples to marry; and

WHEREAS:

The Massachusetts and Hawaii Supreme Courts have found their state ban to be unconstitutional and California, Oregon and New York are currently examining their constitutions; and

WHEREAS:

Massachusetts has begun marrying residents of the same sex; and

WHEREAS:

It is generally believed that the Defense of Marriage Act, disallowing federal recognition of same sex union, will eventually be determined to be unconstitutional; and

WHEREAS:

The federal government does not extend rights and privileges to a citizen of another country in a same-sex unions with an American citizen; and

WHEREAS:

The Permanent Partner Immigration Act before Congress would allow an alien partner to become a United States resident.

THEREFORE BE IT RESOLVED:

That AFSCME will support the adoption of the Permanent Partner Immigration Act that protects the union of same-sex couples.
